Terms of Use

1. About these terms

These Terms of Use ("terms") are an agreement between you and Cantris Technologies Inc. ("Cantris", "we", "us"), a corporation in Canada. They apply to the website at cantris.ai and to our apps for iPhone and iPad, including Multiply Stars, Puddle Paint and Beat Buddies ("the apps").

Our Privacy Policy explains how we handle personal information. It is part of these terms.

2. Licence to use the apps

You get the apps from the Apple App Store. Apple's Licensed Application End User License Agreement (the "Apple EULA") applies to each app. These terms add to the Apple EULA. If these terms and the Apple EULA conflict, the Apple EULA applies.

We give you a personal, non-exclusive, non-transferable licence to use the apps on Apple devices that you own or control, as the App Store usage rules permit.

You agree that you will not:

• copy, change, sell or distribute an app, except as the law permits;
• reverse engineer an app, except where the law permits it;
• use an app in a way that breaks a law.

3. Children and families

Some of our apps are made for children. A parent or legal guardian must accept these terms for a child. The parent or guardian is responsible for the child's use of the app.

Features for grown-ups, for example sharing, settings and tips, are behind a parental gate. Please do not show a child how to open the parental gate.

4. Your content

Pictures, beats, mixes and other things that you or your child make in an app belong to you. They are stored on your device. We do not receive a copy and we claim no rights to them.

If you delete an app, iOS deletes the app's data too, unless you saved or shared it first. We cannot restore data that was deleted from your device.

5. Tips and purchases

Tips are optional and unlock nothing. Apple processes all payments. Apple's terms apply to payments, and Apple handles refunds under its own rules. To ask for a refund, go to reportaproblem.apple.com.

6. Our intellectual property

The apps, the website and their content, including the code, design, characters, sounds, pictures, text and the names "Cantris", "Multiply Stars", "Puddle Paint" and "Beat Buddies", belong to Cantris or to our licensors. Laws on copyright and trademarks protect them. These terms do not give you any right to use our names or logos.

7. Use of the website

You may read, print and link to the pages of this website for personal or non-commercial use. Do not use the website in a way that damages it or stops other people from using it. Do not try to get access without permission to any system that we use.

The website can contain links to other websites, for example the App Store. We do not control those websites and we are not responsible for them.

8. Feedback

If you send us ideas or feedback, we can use them to improve our products. We do not have to pay you for them or keep them confidential. We will not publish your name without your permission.

9. Changes to the apps and the website

We can change, update or stop an app or the website at any time. We try to keep the apps reliable, but we do not promise that an app will be available on all devices or for all versions of iOS.

10. No warranty

To the maximum extent that the law permits, we provide the apps and the website "as is" and "as available", without warranties of any kind. We do not promise that they will always work without errors or interruptions.

Some laws, for example consumer protection laws in Quebec and other provinces, do not let a company exclude some warranties. If such a law applies to you, this section applies only as far as that law permits.

11. Limitation of liability

To the maximum extent that the law permits, Cantris is not liable for indirect, incidental, special or consequential damages, or for loss of data, that come from your use of the apps or the website. Our total liability to you for any claim is limited to the larger of the amount that you paid us in the 12 months before the claim, or 50 Canadian dollars.

Nothing in these terms limits a liability that the law does not let us limit, or your rights as a consumer under the law where you live.

12. Governing law

The laws of the province of Canada where Cantris has its registered office, and the federal laws of Canada that apply there, govern these terms. If you are a consumer, you also keep the protection of the mandatory laws of the place where you live, and you can bring a claim in the courts there.

13. Changes to these terms

We can change these terms. We will put the new version on this page and change the "Last updated" date. If a change is significant, we will show a notice on this website before the change takes effect. If you continue to use the apps or the website after the change, the new terms apply.

14. General

If a court finds that a part of these terms cannot be enforced, the other parts stay in effect. If we do not enforce a right at one time, we can still enforce it later. You cannot transfer these terms to another person without our consent.
